Hart County Board of Commissioners

April 8th, 2003

The Hart County Board of Commissioners met April 8th, 2003 at 5:30 p.m. in the Hart County Administrative & Emergency Services Center.

Chairman Randy Banister presided with Commissioners R. C. Oglesby, Daniel Reyen, Ricky Carter and Joey Dorsey in attendance.

1.         Call to Order  

Chairman Banister called the meeting to order.

2.            Welcome

Chairman Banister welcomed those in attendance.

3.            Prayer  

Chairman Banister offered prayer.

4.                  Pledge of Allegiance

Everyone stood in observance to the Pledge of Allegiance.

5.                  Approve Agenda 

Commissioner Carter entered a motion to amend and approve the agenda as follows:

Commissioner Reyen provided a second to the motion. The motion carried 5-0.

6.                  Approve Minutes of Previous Meeting(s)

3/25/03

Commissioner Oglesby entered a motion to approve the minutes of the meeting held March 25th, 2003. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

7.                  Remarks by Invited Guests, Committees, Authorities, Etc.

a.                  Deborah Gaines - Director Clean & Beautiful

Mrs. Gaines reported that there are twelve participates in the Adopt-a-Highway and eighty-six in the Adopt-a-Spot program. She invited everyone to participate in the Great American Clean-up event scheduled on April 26th, 2003.

Chairman Banister commended Mrs. Gaines for her efforts.

8.                  Reports By Constitutional Officers & Department Heads

County Attorney Walter Gordon reported that Nonpartisan Election for the Magistrate and Probate Judge is pending in the House Governmental Affairs Committee. He also reported that he would keep the board updated on the county wide redistricting issue.

9.            County Administrator's Report

County Administrator Gary Cobb gave a six-month General Fund Financial Report. At six months, the General Fund expenses were at 48.4% of budget and revenues were at 66.75%, 96% of the property taxes had been received.

10.            Chairman's Report  

Chairman Banister announced that there would be a called meeting Thursday April 10th, 2003 at 5:30 p.m. to discuss the County Administrator position.

He asked that the board consider the concept to appoint a research committee to study the property tax process. He also requested that the board consider amending the State of Emergency Ordinance.

11.             Commissioners' Reports

Commissioner Carter reported that a constituent in his district has requested a driveway culvert be installed at a location on Junction 77 Road.

Chairman Banister entered a motion to table the request until they discuss and adopt the proposed Pipe Policy. Commissioner Oglesby provided a second to the motion. The motion carried 5-0.

Commissioner Oglesby entered a motion to approve the Consent Agenda items. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

a.                  Clean & Beautiful Proclamation

Commissioner Reyen entered a motion to adopt the Clean & Beautiful Proclamation. Commissioner Oglesby provided a second to the motion. The motion carried 5-0. The Proclamation is recorded in the minutes book.

b.                  Confederate History & Heritage Month Proclamation

Tom Hardigree read the Confederate History & Heritage Month Proclamation.

Ty Thompson stated that it is time to bring honor to those who have fought for our freedom and liberty.

Chairman Banister commended Mr. Thompson for promoting the historical information.

Deborah Gaines expressed her appreciation to the individuals in the Sons of the Confederate that participate in the litter program.

Commissioner Reyen entered a motion to adopt the Proclamation to proclaim April 26th, 2003 as Confederate Memorial Day. Commissioner Carter provided a second to the motion. The motion carried 5-0.  The Proclamation is recorded in the minutes book.

c.                  Surplus Equipment

Commissioner Oglesby entered a motion to declare items presented by Administrator Cobb plus a Ricoh 4222 copier surplus. Commissioner Dorsey provided a second to the motion.

Administrator Cobb announced that an auction will be held May 10th, 2003 at 10:00 a.m. at the County Maintenance Shop.

The motion carried 5-0.

                        d.            Pre-4th Use of Courthouse Property  

Commissioner Oglesby entered a motion to approve the Junior Service League use of the Courthouse Property with the understanding that the lawn sod be protected during the Pre-4th event.  Commissioner Reyen provided a second to the motion. The motion carried 5-0.

                        e.            Annexation of Recreation Park Property  

Commissioner Oglesby entered a motion to start the process to petition the City of Hartwell to annex in the Recreation Park Property located off Highway 77. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

                        f.            Intra-Department Fund Transfer - Risk Management  

Commissioner Oglesby entered a motion to approve the Intra-Department Fund transfer - Risk Management for Workers Compensation line item. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

g.                  Gravel Spreader Bid

Commissioner Dorsey entered a motion to award the Gravel Spreader bid to BBI at $14,457.52 each two gravel spreaders will be purchased. Commissioner Carter provided a second to the motion. The motion carried 5-0.

h.                  Budget Amendment Resolution 2003-016, Multiple Grant Fund 250

Commissioner Reyen entered a motion to adopt the Budget Amendment Resolution 2003-016. Commissioner Carter provided a second to the motion. The motion carried 5-0. The Resolution is recorded in the minutes book.

i.                    Budget Amendment Resolution 2003-017, SPLOST II Fund 322

Commissioner Oglesby entered a motion to adopt the Budget Amendment Resolution 2003-017. Commissioner Reyen provided a second to the motion. The motion carried 5-0. The Resolution is recorded in the minutes book.

j.                     Budget Amendment Resolution 2003-018, General Fund 100

Commissioner Dorsey entered a motion to adopt the Budget Amendment Resolution 2003-018. Commissioner Oglesby provided a second to the motion. The motion carried 5-0. The Resolution is recorded in the minutes book..

k.                  Public Defender's FY04 Budget

l.                     Public Defender's Contract  

Commissioner Oglesby entered a motion to adopt the Public Defender's FY04 budget and the Public Defender's Contract. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

m.                Contingency Fund Transfer

Commissioner Oglesby entered a motion to approve the Contingency Fund Transfer to provide $20,000 for energy cost for the courthouse and annex buildings. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

n.                  Lease agreement change - Hart Council Domestic Violence

County Attorney Walter Gordon reported that the Hart Council Domestic Violence has reorganized and renamed itself the NE Georgia Council on Domestic Violence.

Commissioner Oglesby entered a motion to table the matter. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

o.                  Board/Authority Appointment

Commissioner Oglesby entered a motion to appoint Florence Gaines to replace Scottie Phillips, who has submitted his resignation, on the Board of Tax Assessors. Commissioner Reyen provided a second to the motion. The motion carried 5-0.
