The Hart County Board of Commissioners met October 14th, 2003 at 5:30 p.m. in the Hart County Administrative & Emergency Services Center.

Chairman Randy Banister presided with Commissioners R C Oglesby, Daniel Reyen, Ricky Carter and Joey Dorsey in attendance.

Chairman Banister called the meeting to order.

Commissioner Reyen entertained a motion to amend the agenda as follows:

                        Approve Minutes 9/23/03 Public Hearing FY04 Budget

Add to item #8, budget amendment Resolution #2004-02

Commissioner Carter provided a second to the motion. The motion carried 5-0.

  1. Approve Minutes of Previous Meeting(s)

Commissioner Reyen entertained a motion to approve the minutes of the meetings held September 23rd, 29th, and October 9th, 2003. Commissioner Carter provided a second to the motion. The motion carried 5-0.

  1. Reports by Constitutional Officers & Department Heads

EMA/EMS Director Terrell Partain announced that the county has been awarded a grant in the amount of $16,505 from the Office of Domestic Preparedness State Homeland Security for the procurement of a security system for the Administration and Maintenance Shop facility.

Commissioner Oglesby entertained a motion to adopt the budget amendment resolution #2004-02 to increase the revenue line item #33.4118 by $16,505 and the expenditures in Department #39200-54.2615 by $16,505. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

Interim Administrator Jon Caime announced the chip sealing process is completed on county roads. He recognized the following county employees for their years of service to the county:

  1. Chairman's Report

Chairman Banister read a letter from Hedrick Isley announcing his resignation as Chairman to the Board of Tax Assessors effective immediately and his resignation on the Assessor board effective December 31st, 2003.

  1. Commissioner's Reports

Commissioner Dorsey reported that Linda Caudell/Jolin's Fish House is requesting clarification on advertising beer and wine via the local newspaper.

After discussing the matter, Commissioner Dorsey entertained a motion to direct County Attorney Walter Gordon to draft a letter to Mrs. Caudell that the local ordinance does not restrict advertising in the newspaper. Commissioner Oglesby entertained a second to the motion. The motion carried 5-0.

  1. Old Business
    a)                  Peer Review of the Hart County Board of Assessors
    Attorney Gordon announced that seven counties have requested a Peer Review since the law was adopted. He said the Review Committee would consist of a member of the Department of Revenue and two assessors from another county in the State of Georgia. He estimated the cost for the review would range between $1,000-$1,500.
    Commissioner Dorsey entertained a motion to proceed with a Peer Review of the Board of Assessors. Commissioner Reyen provided a second to the motion. The motion carried 5-0.
    b)                  Licenses and Fees Resolution
    Attorney Gordon read the amendment to chapter 6-47 Alcoholic Beverages Ordinance for consideration of the amendment for first reading.
    Commissioner Oglesby entertained a motion to accept the amendment on 1st reading. Commissioner Carter provided a second to the motion. The motion carried 5-0.
    c)                  E&S Program Administration Discussion
    After discussing the E&S Program Administration, Commissioner Oglesby entertained a motion to turn the enforcement of the program over to the State. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
    d)                  Fire Truck Bid Award
    Commissioner Oglesby entertained a motion to award the bid to Emergency-One Inc in the amount of $154,914 each and to throw out the low bid submitted by Pierce since they did not meeting the bid specs. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
    e)                  Personal Days for Jail, Sheriff and EMS

Commissioner Oglesby entertained a motion to amend the Personnel policy "Personal Leave" to allow the Jail, Sheriff and EMS personnel to accrue unused Personal leave days as "banked" time effective October 1st, 2003. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

    a)                  Road Paving Bid for 2004
    Commissioner Oglesby entertained a motion to table the matter and discuss it in a Work Session. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
    b)                  ARC Water Tank Resolution
    Commissioner Reyen entertained a motion to adopt the ARC Water Tank Resolution. Commissioner Oglesby provided a second to the motion. The motion carried 5-0. The resolution is recorded in the minutes book.
    c)                  Discussion on Water Permit Trading-Pat Goran Lake Hartwell Association
    Mr. Goran gave a brief background on Georgia Water Laws and respectfully requested that the Board pass a resolution to support water management through a comprehensive state water management plan.
    Commissioner Reyen entertained a motion to prepare a resolution in support of Mr. Goran's request. Commissioner Carter provided to the motion. The motion carried 4-0.  (Commissioner Oglesby left early)
    d)                  Discussion on Formal Agreement with Master Gardeners Club for New Recreation Park
    Attorney Gordon explained that the county acquired the property with grant funds from the Department of Natural Resources and SPLOST funds and that there are some restrictions attached to the grant specifications concerning the use of the property. He suggested that the Board consider a long term lease for maintenance with the Master Gardeners Club.
    The Board directed Mr. Gordon to prepare a lease. Chairman Banister commended the Master Gardeners for their efforts.
    e)                  Request to fund Educational Expenses for Tax Appraisers
    Commissioner Dorsey recommended the transfer of funds from the Board of Tax Assessors education line item to the staff education line item.
    f)                    Budget Resolution #2004-01
    Commissioner Reyen entertained a motion to adopt the budget resolution #2004-01 to fund the Animal Shelter, Hart Partners, Literacy Center, HYDRA, Ninth District Opportunity, DFACS and the DDA. Commissioner Dorsey provided a second to the motion. The motion carried 4-0.
    g)                  Flood Plain Resolution of Intent
    Commissioner Dorsey entertained a motion to adopt the Flood Plain Resolution of Intent. Commissioner Reyen provided a second to the motion. The motion carried 4-0.
    h)                  Letter of Support for DDA Phase II
    Mary Alice Applegate, representing the Downtown Development Authority, requested a letter of support for DDA Phase II project. She explained that the deadline to submit the grant application is October 24th, 2003.
    After discussing the matter, Commissioner Carter entertained a motion to draft a letter of support with no guarantee of funding from the county. Commissioner Reyen provided a second to the motion.
    Commissioner Dorsey entertained a motion to table the request. Commissioner Reyen provided a second to the motion. The motion carried 4-0.
    i)                    Consideration of Funding for Off Duty Police at Recreation Events

Commissioner Reyen entertained a motion to commit funds for off duty policy services during football season. Commissioner Dorsey provided a second to the motion. Commissioner Reyen recommended increasing the recreation user fees. The motion carried 4-0.
