The Hart County Board of Commissioners met March 22nd, 2005 at 7:00 p.m. in the Hart County Administrative & Emergency Services Center.

Chairman R C Oglesby presided with Commissioners Daniel Reyen, Gary Mize, Ricky Carter and Joey Dorsey in attendance.

Chairman Oglesby called the meeting to order.

Chairman Oglesby welcomed those in attendance.

Rev. Martha Dye of Macedonia, Redwine Methodist offered prayer.

  1. Pledge of Allegiance

Everyone stood in observance of the Pledge of Allegiance.

  1. Approve Agenda 

Commissioner Dorsey entered a motion to amend and approve the meeting agenda as follows: Commissioner Reyen provided a second to the motion. The motion carried 5-0

            Move Old Business Item c to April 12th, 2005 meeting & extend the terms of Water Authority members R C Oglesby and Larry Haley until April 30th, 2005.

            Move New Business Item a to Reports By Constitutional Officers

  1. Approve Minutes of Previous Meeting(s)

Commissioner Carter entertained a motion to approve the minutes of the meetings held March 8th, 15th and 16th, 2005. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

  1. Remarks By Invited Guests, Committees, Authorities

  1. Reports By Constitutional Officers & Department Heads 

County Attorney Walter Gordon reported that the Water Authority's Executive Director Tony Smith has tendered his resignation effective immediately and Pat Goran has been named Interim Executive Director. He also reported that Mr. Goran has resigned from his position on the Water Authority and the BOC will need to appoint someone to fill his unexpired term.

Sheriff Mike Cleveland recommended the BOC consider electronic security for the courthouse, close off (3) entrance/exit doors during criminal court cases, allow entrance access on the side of the courthouse facing Forest Avenue, and consider hiring one additional deputy and one additional bailiff.

Chairman Oglesby entertained a motion to approve hiring one additional deputy and bailiff; authorized Sheriff Cleveland and EMS/EMA Director Partain to gather information for the costs to pursue security measures in the courthouse. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

Judge Tise and Judge Hodges thanked the BOC for their support and taking the steps to provide security at the courthouse.

  1. County Administrator's Report

County Administrator Jon Caime reported that the Grand Jury has appointed William Morea and Thomas Peeples on the Board of Equalization.

He announced that he has received preliminary notice that the county has been awarded a grant for mapping software for the Tax Assessors' office.

He also announced that a meeting has been scheduled with the State Economic Development April 12th, 11:00 a.m. in Atlanta.

Commissioner Reyen entertained a motion to reschedule the BOC regular meeting from April 12th, to April 11th, 2005 at 5:30 p.m. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

  1. Commissioners' Reports  

Commissioner Carter reported that the ACCG Deputy Director supports his efforts to try to protect the job market. He also reported that he has discussed several proposed bills with Senator Schaefer and Representative Powell.

Commissioner Carter asked about the status of the courthouse grounds. Administrator Caime responded that the obvious issues are being taken care.

Commissioner Dorsey noted that the DOT has not approved the county's request for assistance for off system safety issues and that there are a number of roads that need striping.

Commissioner Dorsey entertained a motion to proceed with the striping project without DOT assistance. Commissioner Reyen provided a second to the motion.

The vote failed 2-3 (Chairman Oglesby, Commissioners Carter and Mize opposed).

Commissioner Reyen entertained a motion to authorize the County Administrator to compile a list of roads that need immediate striping and the cost for the project for the next scheduled meeting. Commissioner Carter provided a second to the motion. The motion carried 5-0.

Commissioner Dorsey entertained a motion to amend the personal leave and vacation leave to a half day increment. Commissioner Mize provided a second to the motion. The motion carried 5-0.

a)      Bid Award - Lawn Care 

Chairman Oglesby entertained a motion to award the lawn care bid to Evans Lawn Care for 2005 cutting season. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

b)      Health Board Appointment  

Commissioner Mize entertained a motion to appoint Dr. Paul Raber to the Board of Health and his (6) year term of office will expire December 31st, 2010. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

c)      HCWSA Board Appointment moved to April 11th meeting

d)      Bid Award Central Fire Station HVAC  

Commissioner Carter voiced his concern that the vendors did not price the same services for replacing the unit.

After discussing the issue at length, Commissioner Dorsey entertained a motion to award the bid to Hill Service Company and to have all sealed bids come from the County Administrators office. Commissioner Mize provided a second to the motion. The motion carried 3-2 (Commissioners Reyen and Carter opposed).

  1. New Business

b)      Budget Amendment 201 Special Revenue Fund  

Commissioner Dorsey entertained a motion to amend the budget. Commissioner Oglesby provided a second to the motion. The motion carried 5-0.

c)       Clarification of Burdick BOA Appointment Expiration Date 

Chairman Oglesby entertained a motion to clarify that BOA member Don Burdick's term expire December 31st, 2005. Commissioner Dorsey provided a second to the motion.

Mr. Burdick noted that Georgia Code states BOA member terms are three years and he assumed his term expires December 2006.

Pete Nagele noted that Georgia Code sets the BOA terms for three years and does not address unexpired terms.

After discussing the issue, Chairman Oglesby called for the vote. The vote carried 3-2 (Commissioners Reyen and Carter opposed).

d)      Bid Opening - Road Paving  

County Administrator Caime noted that Souder's Asphalt Inc. submitted a late sealed bid. The BOC agreed to accept Souder's sealed bid.

The following companies submitted sealed bids for 2005 road paying projects:

Commissioner Dorsey entertained a motion to defer the bids to the County Administrator for review. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

e)       Depot Street Cable Franchise Agreement 

Commissioner Carter entertained a motion to increase the franchise fees from 3% to 5% and grantee shall remit payment to the county on a quarterly basis. Chairman Oglesby provided a second to the motion. The motion carried 5-0.
