HART COUNTY BOARD OF COMMISSIONERS

JANUARY 12, 1999

PUBLIC HEARING

6:00 P.M.

 

 

Chairman Moore convened the meeting and announced the purpose of the public hearing was to discuss the proposed Zoning Standards Ordinance.

 

County Attorney Walter Gordon gave a brief summary of the proposed Zoning Standards Ordinance. He stated the proposed ordinance outlines standards if the zoning ordinance is adopted.

 

Public Comment

 

Virgil Ayers suggested the board consider holding public hearings for the proposed zoning standards at a facility to accommodate more people comfortably.

 

Wayne Norman asked when the zoning map will be available for the public to review. Chairman Moore stated the map will be available by the next scheduled meeting.

 

Mr. Norman also asked if zoning will affect land values. Chairman Moore responded that zoning will interface with the current land information.

 

Harvey Thompson voiced his concern about his salvage business and wanted to know if he should put the business in his son’s name or if the grandfather clause will protect his interest.

 

Chairman Moore stated that as long as the property has the zoning classification he needs, it won’t be changed.

 

Joe Brandenburg requested the board vote on using another facility for the upcoming proposed zoning ordinance public hearings.

 

Commissioner Oglesby entered a motion to hold the public hearings at the High School or the county courthouse. Commissioner Burdick provided a second to the motion. The motion carried unanimously.

 

Dale Brown stated he disagreed with zoning. He said anytime you say you can’t have agriculture in this area, it is wrong. He asked if there is a grandfather clause in the proposed zoning ordinance and about setbacks for additional poultry houses.

 

Chairman Moore stated the zoning ordinance is farmer friendly.

Lisa Brock asked the board for a definition of the grandfather clause.

 

Chairman Moore stated the grandfather clause meant the established use at the time of adoption of the zoning ordinance may remain in use as long as the current ownership remains.

 

Attorney Gordon stated the grandfather clause concept is covered in the proposed zoning ordinance and will be available for review by the end January.

 

Ms. Brock also asked what the difference is between agriculture and intense agriculture.

 

Chairman Moore stated once the zoning map is available for review it will answer a lot of questions.

 

Chairman Moore presented Commissioner Oglesby with a plaque for his devoted service as chairman for 1998. 

 

Commissioner Oglesby entered a motion to adjourn the meeting. Commissioner Brown provided a second to the motion. The motion carried unanimously.
