The Hart County Board of Commissioners met December 20th, 2002 in the Hart County Administrative & Emergency Services Center at 12 noon.
Chairman Joey Dorsey presided with Commissioners R. C. Oglesby, Don Burdick, Randy Banister and Ken Brown in attendance.
Chairman Dorsey called the meeting to order.
Chairman Dorsey welcomed those in attendance.
Commissioner Banister offered prayer.
Everyone stood in observance of the Pledge of Allegiance.
Commissioner Burdick entered a motion to discuss New Business item b after item i. Commissioner Banister provided a second to the motion. The motion carried 5-0.

a. Bob Smith, Probate Judge
Probate Judge Smith commended County Administrator Gary Cobb for assisting him during the change of the new voting equipment and for providing temporary office help while an employee was out on medical leave.
County Administrator Gary Cobb invited the board to attend the annual employee appreciation luncheon December 23rd, 2002 at Mt. Olivet Elementary School.

a. Appointments
Commissioner Oglesby entered a motion to remove the appointments from the table for discussion. Commissioner Brown provided a second to the motion. The motion carried 5-0.
Commissioner Oglesby entered a motion to appoint Florence Gaines to fill an interim position for thirty-days to fill the vacancy of Earnest Rudeseal to allow Annie Thompson time to go to a certification course; Scottie Phillips to fill the vacancy of Nancy McKay; and reappoint Hedrick Isley to the Board of Tax Assessors. Commissioner Brown provided a second to the motion.
Chairman Dorsey remarked that currently all the Assessor Board is from District two and he felt it would be advantageous to have diversification on the Board.
Pete Nagele stated that he felt it would be appropriate to wait until the two new commissioners take office. Adding that the two new commissioners should have a say-so in the decision.
Commissioner Burdick remarked that he has not nominated all the individuals on the current Tax Assessor Board from district two.
Pete Nagele remarked that sixty percent of property tax funds are from lake owners and recommended appointing Jay Earle on the Tax Assessor Board.
After discussion Chairman Dorsey called for the vote. The vote carried 3-2. With Commissioners Banister and Burdick opposed.
Commissioner Burdick entered a motion to reappoint Jimmy White, Derek Cobb and Lenford Smith to the Recreation Advisory Board. Commissioner Banister provided a second to the motion. The motion carried 5-0.

Commissioner Burdick entered a motion to remove the items from the table for discussion. Commissioner Brown provided a second to the motion. The motion carried 5-0.
Chairman Dorsey entered a motion to approve Wanda Cordell’s beer and wine license application. Commissioner Brown provided a second to the motion. The motion carried 5-0.
Commissioner Oglesby entered a motion to approve Carole Haynes’ beer and wine license application. Commissioner Brown provided a second to the motion. The motion carried 5-0.
Commissioner Oglesby entered a motion to approve Mike Scruggs’ beer and wine license application. Commissioner Brown provided a second to the motion. The motion carried 5-0.
a. Liability/Property Insurance Bids
County Administrator Cobb stated that Franklin Insurance Company and ACCG/IRMA submitted bids for the Liability/Property Insurance. He recommended ACCG/IRMA proposal.
Commissioner Burdick entered a motion to accept ACCG/IRMA bid proposal of $149,117. Commissioner Brown provided a second to the motion.
Chairman Dorsey questioned the nine month quote from ACCG.
Ben Pittarelli, representing ACCG, explained that the amount will be prorated for nine months because ACCG renews policies on October 1st. He reported that the pool has twenty eight million dollars in assets, they are a non-profit organization made up of county governments. He also reported that they aggressively defend claims if it’s in the county’s best interests.
Joe Cooper, representing Franklin Insurance, asked the board to accept his proposal through C N A of $151,832 and the county would not be locked in for two years as required by ACCG. He stated that he felt it was important to have local representation.
Chairman Dorsey voiced his concern that the county’s hands would be tied for two years with ACCG. Adding that ACCG could reassess the county higher based on our losses.
County Administrator Cobb remarked that on the flip side the county is guaranteed liability insurance coverage for two years. Where previously two insurers have dropped parts of all of the County’s liability insurance coverage in four years.
Joe Cooper recommended the county consider a third party consultant to review the insurance coverage.
Chairman Dorsey called for the vote. The vote carried 3-1, with Chairman Dorsey opposed. Commissioner Brown left the meeting prior to the vote.
Commissioner Oglesby entered a motion to adopt the ACCG/IRMA Intergovernmental Contract Resolution. Commissioner Burdick provided a second to the motion. The motion carried 4-0.
Commissioner Oglesby entered a motion to adopt the budget amendment to increase the liability insurance line item by $24,117. Commissioner Banister provided a second to the motion. The motion carried 4-0.

Commissioner Oglesby entered a motion to grant EMS employee James Smith with six years experience retroactive to date of hire. Commissioner Burdick provided a second to the motion. The motion carried 4-0.
d. Lake Hartwell Marketing Alliance Request
Commissioner Banister entered a motion to table the request. Commissioner Burdick provided a second to the motion. The motion carried 4-0.
e. Subdivision Plat Variance – Michael Rider
Commissioner Banister entered a motion to table the request. Chairman Dorsey provided a second to the motion. The motion carried 4-0.
f. General Fund Budget Amendment – Sheriff’s Dept. Vehicle
Commissioner Oglesby entered a motion to increase the Sheriff’s Department line item 54.2200 Capital/Vehicles by $11,500. Commissioner Burdick provided a second to the motion. The motion carried 4-0.
g. Agnew Subdivision
Commissioner Banister entered a motion to approve Agnew Subdivision request. Commissioner Burdick provided a second to the motion. The motion carried 4-0.
h. Grant Subdivision
Commissioner Burdick entered a motion to approve Grant Subdivision request. Commissioner Banister provided a second to the motion. The motion carried 4-0.
i. Beer & Wine License Renewal-Wilson Yeast/Hickory Crossing Grocery
Commissioner Burdick entered a motion to approve Wilson Yeast’s beer and wine license application. Commissioner Banister provided a second to the motion. The motion carried 4-0.
b. LOST
Commissioner Oglesby entered a motion to accept arbitrator Denny Galis’ recommendation of 21% of LOST revenue to the City of Hartwell and 3% to the City of Royston for ten years. Commissioner Burdick provided a second to the motion. The motion carried 4-0.
Commissioner Oglesby entered a motion to pay the City of Hartwell’s RDC dues annually. Chairman Dorsey provided a second to the motion. The motion was split 2-2, with Commissioner Banister and Burdick opposed.
