The Hart County Board of Commissioners met July 9th, 2002 at 5:30 p.m. in the Hart County Administrative & Emergency Services Center.
Chairman Joey Dorsey presided with Commissioners R. C. Oglesby, Don Burdick, Randy Banister and Ken Brown in attendance.
Chairman Dorsey called the meeting to order.
Chairman Dorsey welcomed those in attendance.
Prayer Commissioner Burdick offered prayer.
Everyone stood for the Pledge of Allegiance.
Commissioner Banister entered a motion to amend and approve the meeting agenda as follows:

Commissioner Oglesby entered a motion to approve the minutes of the meetings held June 25th, and June 28th, 2002. Commissioner Brown provided a second to the motion. The motion carried 5-0.

Phil Hix-Tax Commissioner/Delinquent Tax Collection Status
Tax Commissioner Phil Hix reported on the status of the delinquent tax collection after the recent audit report. He reported that individuals are being billed for boats that they failed to report that they no longer own. Therefore, there is not a need to pursue collection of delinquent taxes.
County Attorney Walter Gordon reported that the tax collection record for Hart County is outstanding and commended Tax Commissioner Hix for his efforts.
Commissioner Burdick remarked that when the delinquent tax sales were pursued that one million dollars was collected during that time. He suggested that the Tax Commissioner pursue additional tax sales.
Attorney Gordon recommended that tax sales start again in 2003.
Commissioner Burdick entered a motion to recommend that Tax Commissioner Hix pursue delinquent sales in 2003. Chairman Dorsey provided a second to the motion. The motion carried 5-0.
County Administrator Gary Cobb did not have anything to report.
Chairman Dorsey read a letter from the Mayor of Hartwell rejecting the county’s proposal for binding arbitration to settle the dispute over the 1% Local Option Sales Tax revenues. They City requested that they continue to receive the current twenty-three percent through 2003 and continue to try to resolve the issue.
Chairman Dorsey reported that he has gotten complaints from residents in the Hartwell Speedway area concerning the racetrack. He said the owner of the track is allowing individuals to use it late at night. He suggested that the board consider a noise ordinance.
Commissioner Oglesby entered a motion to host a fish fry for the volunteer fire department for their efforts in lowering the ISO rating. Commissioner Brown provided a second to the motion. The motion carried 5-0.
a. EMA Ordinances (4)
Commissioner Oglesby entered a motion to remove the EMA Ordinances from the table for discussion. Commissioner Brown provided a second to the motion. The motion carried 4-1. Commissioner Banister opposed.
Chairman Dorsey stated that three events must take place before a curfew would take effect: 1. A disaster or emergency must occur, 2. A state of emergency must be declared. 3. The Board must vote to enact the curfew.
13a1. Commissioner Burdick entered a motion to adopt the Ordinance Authorizing the Suspension of Portions of the Code of Ordinances & Other Formalities During a State of Emergency. Chairman Dorsey provided a second to the motion. The motion carried 4-1. Commissioner Banister opposed.
13a2. Commissioner Burdick entered a motion to adopt the Ordinance Authorizing the Imposition of Curfews During Times of Emergency or Disaster. Chairman Dorsey provided a second to the motion.
Commissioner Banister remarked that the ordinance was extremely wide open, that it restricts personal freedom and that it was bureaucracy from GEMA.
Tom Hardigree voiced opposition to the ordinance. Adding that the county got along fine without it.
The motion carried 4-1. Commissioner Banister opposed.
13a3. Commissioner Burdick entered a motion to adopt the Ordinance to Prohibit Overcharging For Goods, Materials, Services & Housing During a State of Emergency. Commissioner Brown provided a second to the motion. The motion carried 4-1. Commissioner Banister opposed.
13a4. Commissioner Burdick entered a motion to adopt the Ordinance to Require Registration of Building & Repair Services During a State of Emergency. Commissioner Brown provided a second to the motion. Commissioner Banister remarked that the ordinance was meaningless and premature.
Troy Worthey remarked that the county does not have an inspection system and it would be ridiculous to adopt the ordinance.
The motion carried 4-1. Commissioner Banister opposed.
b. Board/Authority Appointments
Chairman Dorsey entered a motion to reappoint Bud Brown to serve on the Franklin/Hart Airport Authority. Commissioner Brown provided a second to the motion. The motion carried 5-0.
Commissioner Oglesby entered a motion to table appointments to DFACS and RDC until the next meeting. Commissioner Brown provided a second to the motion. The motion carried 5-0.
a. Change Order #1-Recreation Park Grading
Commissioner Brown entered a motion to adopt Change Order #1-Recreation Park Grading. Commissioner Oglesby provided a second to the motion. The motion carried 5-0.
b. Change Order #5-Literacy Center
Commissioner Oglesby entered a motion to adopt Change Order #5-Literacy Center to allow seven additional days on the architect’s contract. Commissioner Brown provided a second to the motion. The motion carried 5-0.
c. Request for Indemnification by Public Works Director Jon Caime
Commissioner Brown entered a motion to resolve to provide indemnification for the Public Works Director Jon Caime. Commissioner Banister provided a second to the motion. The motion carried 5-0.

e. Budget Amendment-Auditor’s Services
Commissioner Oglesby entered a motion to amend the budget for the Internal Audit Department line item 52.1240 for an additional $12,598 and Library Administration 52.1240 for an additional $1,730 from the fund balance. Commissioner Brown provided a second to the motion. The motion carried 5-0.

g. Surplus County Property
Commissioner Oglesby entered a motion to table the Surplus County Property discussion until the Sheriff submits a listing of property to be deemed surplus. Commissioner Brown provided a second to the motion. The motion carried 5-0.
h. Department of Transportation-Section 5311 Application
Commissioner Oglesby entered a motion to adopt the Department of Transportation-Section 5311 grant application and allow the Chairman to execute the documents. Commissioner Burdick provided a second to the motion. The motion carried 5-0.
i. Budget Amendment-Elections/Probate Court, Inter-Departmental Transfer
Commissioner Banister entered a motion to adopt the budget amendment to transfer $3,000 from the Election Department 52.3854 to the Probate Court to line item 51.1100. Commissioner Oglesby provided a second to the motion. The motion carried 5-0.
j. Fire Hydrant Funding
Commissioner Burdick entered a motion to purchase ten fire hydrants from the Life Insurance Premium Tax Account. Commissioner Oglesby provided a second to the motion. The motion carried 5-0.
k. Budget Amendment-Literacy Center Utilities
Commissioner Oglesby entered a motion to approve the Budget Amendment for $6,000 for the Literacy Center utilities through the remainder of the fiscal year from fund balance. Commissioner Brown provided a second to the motion. The motion carried 5-0.
l. Proposed changes to Section 2. – Intoxicants of the Personnel Policy Manual
Commissioner Banister entered a motion to adopt the changes to Section 2 – Intoxicants of the Personnel Policy Manual. Commissioner Burdick provided a second to the motion. The motion carried 5-0.
m. Board of Registrars’ Compensation
Commissioner Oglesby entered a motion that the salary for Board of Registrar Mary Ann Franklin to remain at the level she currently receives. The motion died for lack of a second.
Commissioner Burdick entered a motion that the salary be state minimum plus a three and half percent COLA. The motion died for a lack of second.
Commissioner Oglesby entered a motion that the salary be state minimum plus credit Ms. Franklin with five years experience. Commissioner Banister provided a second to the motion. The motion carried 4-1. Commissioner Burdick opposed.
