The Hart County Board of Commissioners met
September 10th, 2002 at 5:30 p.m. in the Hart County Administrative
& Emergency Services Center.
Chairman Joey Dorsey presided with Commissioners R. C. Oglesby, Donald Burdick, Randy Banister and Ken Brown in attendance.
Chairman Dorsey called the meeting to order.
Chairman Dorsey welcomed those in attendance.
Chairman Dorsey opened with prayer.
Everyone stood in observance of the Pledge of Allegiance.
Commissioner Burdick entered a motion to amend and approve the meeting agenda as follows:

Commissioner Oglesby entered a motion to approve
the minutes of the meetings held August 27th and August 29th, 2002.
Commissioner Brown provided a second to the motion. The motion carried 5-0.

County Attorney Walter Gordon reported that the Hart County Water & Sewer Authority held a called meeting and accepted the low bid for the Hodges Mill Road Water Project.
County Administrator Gary Cobb reported the Water & Sewer Authority has adopted a drought contingency plan.
He announced that according to the Hart County-Tax
Assessor Board Chairman anyone wishing to appeal their property values must do
so in writing by October 9th, 2002 at 5:00 p.m.
Chairman Dorsey announced that the Literacy Center
officially opened Sunday, September 8th, 2002.
Commissioner Banister entered a motion to install children at play; blind drive and speed zone signs on Sunset Drive. Commissioner Burdick provided a second to the motion. The motion carried 5-0.
Commissioner Banister requested repairing the
recording system.
Commissioner Brown reported that the DOT selected
the following roads for asphalt agreement paving assistance: Ank Powell (paved portion), Walt Wilson,
Arrow Lane and Harbor Heights Circle in Commissioner District 4.

b. Renaming & Renumbering Roper Road
Commissioner Brown entered a motion to remove the
item from the table for discussion. Commissioner Banister provided a second to
the motion. The motion carried 5-0.
County Administrator Cobb reported that residents
on Roper Road were sent a notification of the proposed change however, no one
responded opposing the change.
Commissioner Burdick entered a motion to rename a
portion of Roper Road to Old Roper Road. Commissioner Brown provided a second
to the motion. The motion carried 5-0.

LOST
Chairman Dorsey read a proposal from the Mayor Matt
Beasley stating the City of Hartwell will agree to 22-½% of LOST revenues for
the next ten years.
Commissioner Oglesby expressed that the county
should move as swiftly as possible to resolve the LOST matter.
Commissioner Oglesby entered a motion to take the
City of Hartwell’s offer under consideration and meet with the City of
Bowersville, Canon and Royston Thursday September 12th, 2002 at 5:30
p.m. Chairman Dorsey provided a second to the motion. The motion carried 5-0.

Commissioner Burdick entered a motion to defer the
bids to the County Administrator, Fire Chief and Assistant Fire Chief to review
and make a recommendation to the Board. Commissioner Brown provided a second to
the motion. The motion carried 5-0.

Commissioner Oglesby entered a motion to defer the
bids to the County Administrator and Public Works Director to evaluate and
pursue purchasing the vehicles. Commissioner Brown provided a second to the
motion. The motion carried 5-0.
c.
Public Hearing FY03 General Fund Budget & Proposed BOC Millage
County Administrator Cobb made a presentation of
the FY’03 proposed budget for the General Fund. He said the proposed millage would be a decrease from last year's
budget from 5.93 to 4.97.
Real Estate Agent Bruce Bate said since property
assessment notices have gone out he has gotten numerous calls reporting that
values have gone up from 60 to 100%. He said the problem with the current
assessment is the method used to determine fair market value. He added that the
Tax Assessors apply the profit on property that sells to the value of the
property. He reported that the profit on a deal is split between the
contractor, lawyer and real estate agent.
Hart County Library Director Richard Sanders asked
that the Board reconsider the proposed budget for the Library of $94,100. He
said the State has cut Library material funds and whatever consideration to
increase the county’s portion would help.

Commissioner Oglesby entered a motion to accept
Change Order #2 extending the grading contract by thirty days. Commissioner
Banister provided a second to the motion. The motion carried 4-0. (Commissioner
Brown was not in attendance)
f. Surplus County Equipment
Commissioner Oglesby entered a motion to adopt the
Resolution to declare and dispose of the county's mechanical voting machines.
Commissioner Burdick provided a second to the motion. The motion carried 5-0.

Commissioner Oglesby entered a motion to grant a
variance for Champayne Shores Subdivision. Commissioner Burdick provided a
second to the motion. The motion carried 4-0. Commissioner Banister abstained.

Commissioner Burdick entered a motion to approve
the subdivision request. Commissioner Banister provided a second to the motion.
The motion carried 5-0.

the subdivision request. Commissioner Brown provided a second to the motion.

m. Renaming Gaines Court
Commissioner Burdick entered a motion to table the
matter. Commissioner Brown provided a second to the motion. The motion carried
5-0.

Pilot Club Use of County Seal
Commissioner Oglesby entered a motion to allow the
Pilot Club use of the County Seal. Commissioner Brown provided a second to the
motion. The motion carried 5-0.

Item was moved to the first item under New
Business.
p. Amendment Personnel Policy -Drug and
Alcohol Policy
Commissioner Burdick entered a motion to amend the
Personnel Policy to revise Section 2.8 Intoxicants. Commissioner Banister
provided a second to the motion. The motion carried 5-0.
Donnie Black of Lavonia Speedway remarked that he
would like to participate and offer suggestions and ideas for a noise ordinance
pertaining to racetracks. He said Lavonia Speedway runs a clean show and tries
to be a good neighbor.
Chairman Dorsey remarked that he has received
complaints from neighbors in the area of Hartwell Speedway. He said the board
has not considered a noise ordinance.
Max King the announcer at Lavonia Speedway stated
he appreciated the board not taking action against the speedway.
Lee Freeman said he attends Hartwell and Lavonia
Speedway and that both speedways are run the same way. He said overtime at the
track is due to a lot of cautions and the number of cars in the race. He said
racing is a family affair and the board should take that into consideration.
Judy Palmer remarked that Hartwell Speedway is not
as well organized as Lavonia Speedway. However, they are taking necessary steps
to improve the speedway. She said they are trying to get finished by 12:30 -
1:00.
Executive Session
a. Litigation matter
Commissioner Oglesby entered a motion to exit into
executive session to discuss litigation matters as required by O.C.G.A.
50-14-2, 5-14-3 and 50-14-4(b). Commissioner Brown provided a second to the
motion. The motion carried 5-0. The Resolution and Affidavit is recorded in the
minutes book.
Chairman Dorsey called session to order. Those
Commissioners in attendance were: Banister,
Brown, Burdick, Oglesby and Dorsey. Also present were Walter Gordon and Gary
Cobb.
County Attorney Gordon reviewed the status of
ongoing litigation and a potential litigation circumstance.
Adjournment
With no further action taken during executive
session, Commissioner Burdick entered a motion to exit executive session and
adjourn the meeting. Chairman Dorsey provided a second to the motion. The
motion carried 4-0.
