Beer & Wine Ordinance Work Session
April 20th, 2005

The Hart County Board of Commissioners met April 20th, 2005 at 5:00 p.m. in the Administrative & Emergency Services Center to discuss the beer & wine ordinance.
Chairman R C Oglesby presided with Commissioners Daniel Reyen, Gary Mize, Ricky Carter and Joey Dorsey in attendance.
The BOC began with Section 6.1 Definitions.
Commissioner Dorsey entertained a motion to define "Daycare Facility" as a commercial based facility. Commissioner Carter provided a second to the motion. The motion carried 5-0.
Chairman Oglesby entertained a motion to define "Entrance" as being the front door of an establishment. Commissioner Reyen provided a second to the motion. The motion carried 5-0.
Commissioner Reyen entertained a motion to define
"Malt Beverage" as per the State of
Commissioner Reyen entertained a motion to defer the definition of "Recreational Facility" to the County Attorney for clarification. Commissioner Carter provided a second to the motion. The motion carried 5-0.
Rev. Mike Griffin questioned the action on defining "Malt Beverage" as per the State.
Commissioner Reyen entertained a motion to rescind the vote on "Malt Beverage". Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
Commissioner Dorsey entertained a motion to defer "Malt Beverage" issue to the County Attorney for clarification. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
Commissioner Carter entertained a motion that restaurant owners would have to present evidence that at least 55% of its total annual gross income was derived from the sale of prepared meals or food at renewal. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
Commissioner Reyen entertained a motion to define "Church" as a primary structure where worship services are conducted on a regular basis. Commissioner Carter provided a second to the motion. The motion carried 5-0.
Section 6-2 Types of Licenses
Commissioner Reyen entertained a motion that Class A licenses allow the retail sales of malt beverage & wine for on premises only, Class B licenses allow the retail sales of malt beverages & wine for off-premises consumption only. Commissioner Mize provided a second to the motion. The motion carried 5-0.
Commissioner Reyen entertained a motion to allow an establishment to have multiple licenses. The motion failed from a lack of a second.
Commissioner Mize entertained a motion to adjourn the work session. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
The work session will continue April 26th, 2005 at 5:00 p.m.
