Hart County Board of Commissioners Work Session

The Hart County Board of Commissioners met May 17th, 2005 at 5:30 p.m. in the Hart County Administrative & Emergency Services Center to discuss the proposed SPLOST III and the Beer and Wine Ordinance.

 

Chairman R C Oglesby presided with Commissioners Daniel Reyen, Gary Mize, Ricky Carter and Joey Dorsey in attendance.

 

County Administrator Jon Caime explained the various funding requests.  The following actions were taken as a tentative step toward determining the SPLOST funding referendum.  These actions assume a City/County government agreement will be reached and a 6 year $15.6M SPLOST referendum will be approved.  These actions will be refined in upcoming SPLOST III meetings as the funding referendum is finalized:

  • Commissioner Reyen made a motion to preliminarily fund the $99,000 City of Royston and $33,000 City of Bowersville requests.  Motion was seconded by Commissioner Dorsey and approved 5-0.
  • Chairman Oglesby made a motion to preliminarily fund the Fire Dept. request of $1.36M.  Motion was seconded by Commissioner Dorsey and approved 5-0.
  • Chairman Oglesby made a motion to preliminarily fund $2.7M of the Economic Development request and $0.5M Economic Development funds for the Lake Hartwell Multipurpose Facility. Motion was seconded by Commissioner Dorsey and approved 5-0.
  • Chairman Oglesby made a motion to preliminarily fund $3.2M of the Water Infrastructure request. Motion was seconded by Commissioner Reyen and approved 5-0.
  • Chairman Oglesby made a motion to preliminarily fund $1.36M towards Recreation Infrastructure.  Motion was seconded by Commissioner Reyen and approved 5-0.
  • Commissioner Reyen made a motion to preliminarily fund any remaining funds towards roads.  Motion was seconded by Commissioner Carter and approved 5-0.
  • Commissioner Dorsey made a motion to commit to complete the current ball field recreation project as soon as possible if the SPLOST III is passed in November 2005 by borrowing funds (estimated to be approximately $700,000) from the General Fund Fund Balance.  Motion was seconded by Commissioner Reyen and approved 5-0.

 

Chairman Oglesby discussed a request to allow a private citizen permission to graze goats on County land that is getting overgrown with vegetation.  Commissioner Reyen made a motion to allow this person to do this if the person pays the County’s costs for developing an indemnity against any potential liability.  Commissioner Carter seconded the motion, and the motion passed 5-0.

 

After a brief recess the Board reconvened to discuss the Beer and Wine Ordinance Revision and took the following actions:

 

  • Section 6-34 (b) (7) Hearing, consideration, denial

Commissioner Dorsey entertained a motion to allow a perspective owner of an establishment to make application to the BOC for a malt beverage & wine license during construction of an establishment or during the process of a change in ownership of an establishment. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

 

  • Section 6-34 (e) 

Commissioner Reyen entertained a motion that the front of the building shall have a window; & no screen, blind, curtain, partition, article, advertisement of thing that shall prevent a clear view into the interior of the building shall be permitted in the window or upon the doors of any building where retail sales are permitted. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

  • Section 6-34 (b) (6)

Commissioner Reyen entertained a motion to amend the proximity of the business to 100 yards of a church, school, hospital or day care facility. The motion died from a lack of a second.

 

Commissioner Dorsey entertained a motion that the proximity remain at 350 yards of a church, school, hospital or day care facility. Commissioner Mize provided a second to the motion. The motion carried 4-1 (Commissioner Reyen opposed).

 

  • Section 6-64 (7)

Commissioner Oglesby entertained a motion to include evidence presented to the BOC in favor to the issuance of a license. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

  • Section 6-64 (e) 

Commissioner Reyen entertained a motion that advertisements to be included in section e. Commissioner Carter provided a second to the motion. The motion carried 5-0.

 

  • Section 6-65 (d) Grocery Related Inventory

Commissioner Reyen entertained a motion that grocery related inventory in a retail establishment have a wholesale value of not less than $20,000. The motion died from a lack of a second.

 

Commissioner Dorsey entertained a motion that grocery related inventory in a retail establishment have a wholesale value of not less than $5,000. Chairman Oglesby provided a second to the motion. The motion failed 2-3 (Commissioners Reyen, Mize and Carter opposed).

 

Commissioner Carter entertained a motion that grocery related inventory in a retail establishment have a wholesale value of not less than $10,000. The motion died from a lack of a second.

 

Commissioner Carter entertained a motion that grocery related inventory in a retail establishment have a wholesale value of not less than $7,500 in grocery related perishable items. Commissioner Reyen provided a second to the motion. The motion carried 3-2 (Chairman Oglesby and Commissioner Dorsey opposed).
