Hart County Board of Commissioners met
Chairman R C Oglesby presided with Commissioners Daniel Reyen, Gary Mize, Ricky Carter and Joey Dorsey in attendance.
Chairman Oglesby called the meeting to order.
Chairman Oglesby welcomed those in attendance.
Rev. Nelms of the 1st Presbyterian Church of Hartwell offered prayer.
Everyone stood in observance of the Pledge of Allegiance.
Commissioner Reyen entertained a motion to amend and approve the meeting agenda as follows:

Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
Commissioner Reyen entertained a motion to approve the minutes as amended 7/26 - 8/18/05. Commissioner Mize provided a second to the motion. The motion carried 5-0.

County Attorney Walter Gordon noted that he did not have anything to report other than would brief the BOC during Executive Session on potential litigation matters.

Commissioner Carter requested a work session to discuss issues with sides of county roads within the right-of-way and the option to bring bushhogging back in-house.
Commissioner Dorsey reported that the county received a letter from the DOT in response to traffic lights at several dangerous intersections in the county and they did not recommend installing traffic lights. Commissioner Dorsey commended Administrator Caime for his efforts.
Commissioner Reyen entertained a motion to approve Oak Park Subdivision, Phase V. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
a) Holt Refund #2
Commissioner Reyen entertained a motion to approve Mr. Holt's tax refund request for year 2002 in the amount of $45.96.
Attorney Gordon explained that the request for refund for 2000-2001 was beyond the three year time limit requirement.
Commissioner Dorsey provided a second to the motion.
Commissioner Carter asked where the funds to refund Mr. Holt would come from. Attorney Gordon responded that the funds would be paid from un-remitted funds in the Tax Commissioner's office. The vote carried 5-0.
b) Cotton States Insurance
Commissioner Mize entertained a motion to table the issue. Commissioner Reyen provided a second to the motion. The motion carried 5-0.
a) FY06 Proposed Tax Millage Rate - Incorporated & Unincorporated
After discussing the issue, Commissioner Reyen entertained a motion to table the matter. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
Chairman Oglesby directed Administrator Caime to schedule a meeting with the Board of Tax Assessors to discuss the tax digest.

After discussing the issue, Commissioner Reyen entertained a motion to table the matter. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

f) DDA request to use Courthouse Grounds
Commissioner Reyen entertained a motion to allow DDA use of the amphitheatre area on the Courthouse grounds September 17th. Commissioner Dorsey provided a second to the motion. Commissioner Carter stated that the county's policy is not to attract people to grass areas but to the amphitheatre area only. The motion carried 5-0.

h) Little League Tournament Reimbursement
Chairman Oglesby entertained a motion to approve reimbursement expenses in the amount of $2,500 to the Little League from General Fund fund balance providing that receipts for the funds are submitted to the Administrative office along with a written request. Commissioner Carter said that the county doesn't help 4H, Boy Scouts are anyone else with tournament expenses. The motion carried 3-2 (Commissioners Reyen and Carter opposed).
i) Personnel Policy Amendment - Exit Interview
Commissioner Reyen entertained a motion to amend the Personnel Policy to require an Exit Interview with anyone that is leaving employment with the county. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.
j) Credit for prior years experience - Sheriff Deputy
Commissioner Dorsey entertained a motion to allow eight years prior experience for Deputy Pierce Mize retroactive to date of employment. Commissioner Reyen provided a second to the motion. The motion carried 4-0. (Commissioner Mize abstained due to the relationship)
k) Health Department Fees
Chairman Oglesby entertained a motion to increase all Environmental fees with the exception of septic tank permit fees as recommended by the Board of Health. Commissioner Dorsey provided a second to the motion. The motion carried 3-2 (Commissioners Reyen and Mize opposed).
l) NIMS Adoption Ordinance
Chairman Oglesby entertained a motion to accept the 1st reading of the NIMS Ordinance. Commissioner Carter provided a second to the motion. The motion carried 5-0.
Recreation Director Curry noted that she reviewed the Recreation Uniforms bids. Commissioner Reyen entertained a motion to award the bid to Dillard's Sporting Goods. Commissioner Mize provided a second to the motion. The vote carried 5-0.
Chairman Oglesby entertained a motion to allow Rec Director Curry to use the plan that she has implemented requiring players to return their uniforms after the season. Commissioner Reyen provided a second to the motion. The motion carried 5-0.
Chairman Oglesby entertained a motion to award the bid for cheerleader uniforms to Royal Graphics. Commissioner Reyen provided a second to the motion. The motion carried 5-0.

Commissioner Dorsey entertained a motion to enact a moratorium on motor sports operating Thursday-Sunday to cease operations at 9:00 pm. Commissioner Reyen provided a second to the motion. The motion carried 5-0.
Attorney Gordon suggested the BOC consider enactment of business licenses in the unincorporated areas of the county.
Commissioner Reyen requested placing the business license issue on the second meeting in September agenda.
p) Road Stone Hauling
Commissioner Reyen entertained a motion to award the road stone hauling to the second lowest bidder at $5/ton. Commissioner Mize provided a second to the motion. The motion carried 5-0.

a) Potential Litigation
Chairman Oglesby entertained a motion to exit into Executive Session to discuss potential litigation as required by OCGA § 50-14-2, § 50-14-3 and § 50-14-4(b). Commissioner Reyen provided a second to the motion. The motion carried 5-0. The resolution is recorded in the official minutes book.
With no further action taken during Executive Session, Chairman Oglesby entertained a motion to exit. Commissioner Reyen provided a second to the motion. The motion carried 5-0.
